At a glance

Andalusian close-family allowance
€1,000,000 per heir
For qualifying close-family heirs under the regional rules.
Further Andalusian relief
99%
Non-EU families can also access regional treatment when the conditions are met.
Simplest practical step
A Spanish will
Covering Spanish assets can make the later administration clearer.

For close family, the tax can be much smaller than the fear

For a spouse or child inheriting an Andalusian home, the €1,000,000 allowance per qualifying heir and 99% relief can bring the tax close to zero. That is not the same as having nothing to file.

The inheritance still needs to be accepted, valued, filed and registered within the practical timetable. A short Spanish will and an organised ownership file remove work from the people you love.

The family file to make clear now

Spanish will
A will limited to Spanish assets can sit beside your home-country planning and make the Spanish administration more direct.
Choice of national law
Under EU Regulation 650/2012, a foreign owner can expressly choose their national succession law in the will.
The filing clock
Inheritance filings belong inside 6 months, so the family should know who to call and where the papers are.

Questions worth settling while the file is simple

Should I buy in my own name or through a company?

For a lifestyle home, a company is usually more administration without a purchase-tax saving and can complicate inheritance relief. Some non-cooperative-jurisdiction companies also face an annual levy of 3%. Use a company only when your own tax adviser can name a real business reason.

What happens to the home when I die?

A Spanish will covering Spanish assets usually makes the practical work simpler, and you can elect your national succession law under EU Regulation 650/2012. In Andalusia, close family can have an allowance of €1,000,000 per heir plus 99% relief, but the filing still belongs inside 6 months.
