Ashworth & Drake is a guide for people buying a home in Spain. We introduce buyers to a local expert who knows the town they are looking in. This policy explains what personal information we collect when you use www.ashworthdrake.com, what we do with it and the rights you have over it.

Advertia LLC also operates the Fondaro platform, which runs this website, our lead handling, our email and the front desk chat. Because it is the same company, using Fondaro to run this site is not a disclosure of your information to anyone else.

The information we collect

Information you give us

You give us information when you fill in a form on this site, use the "find your local expert" questionnaire, or start a conversation in the front desk chat. Depending on the form, that can include:

  • your first and last name
  • your email address
  • your phone number, if you choose to give one
  • the language you prefer to be contacted in
  • the brief itself: the areas you are looking in, the type of home, budget, number of bedrooms and bathrooms, features that matter to you and roughly when you plan to buy
  • anything else you choose to write to us, including messages in the front desk chat and any listing you were looking at when you wrote

You do not have to give us any of this. Not filling in a form simply means we cannot introduce you to anyone.

Information collected automatically

Like any website, this site is served by a hosting provider that keeps short-lived technical logs, including your IP address, the pages requested, your browser and device type and the time of the request. These logs exist to keep the site running and secure.

We also set a small number of cookies, and, if you accept them, allow Meta to set marketing cookies. Which cookies, what each one does and how to change your mind are covered in our cookie policy.

We run no analytics product on this site. The Meta Pixel described below is the only third-party tracker, and it does not load until you accept it.

Why we use it, and our legal basis

  • To answer you and make an introduction. When you send us a brief or a message, we use your details to reply and to introduce you to a partner agent who covers the area you asked about. Legal basis: steps taken at your request before entering into a contract, and our legitimate interest in running an introductions service.
  • To keep a record of the introduction. We keep the brief and our correspondence so the introduction is traceable and so we can pick a conversation back up if you return. Legal basis: our legitimate interest in running the service and keeping accurate records.
  • To measure and improve our advertising. If you accept marketing cookies, Meta tells us in aggregate which campaigns bring people to the site. Legal basis: your consent, which you can withdraw at any time.
  • To keep the site available and secure. Legal basis: our legitimate interest in protecting the site.
  • To meet legal obligations. Where a law requires us to keep or hand over information, that law is the basis.

We do not sell your personal information, and we do not use it to make automated decisions that have a legal or similarly significant effect on you.

Who we share it with

  • The partner agent we introduce you to. This is the point of the service. We pass on your name, your contact details and your brief so the agent can pick up where you left off. They are a separate controller of that information from the moment we pass it on and handle it under their own privacy policy. We tell you who the agent is when we make the introduction.
  • Our hosting and infrastructure providers, who serve the site, store its content and deliver our email. They process the information on our instructions and do not use it for their own purposes.
  • Meta, but only if you accept marketing cookies. Meta Platforms, Inc. processes that data in the United States as an independent controller for its own purposes as well as ours. See the cookie policy for what is shared and how to withdraw consent.
  • Professional advisers and authorities, where we are required to disclose information by law.

Property listings on this site

The homes shown on this site are not ours. They are drawn live from the Resales Online network, the shared multiple listing system used by agencies on the Spanish coast. Browsing a listing does not tell the listing agency anything about you. Information about you reaches an agency only when you ask us to make an introduction, or when you contact them yourself.

Where your information is held

We are a United States company, and the information described here is processed in the United States and, depending on the provider, in the European Economic Area.

Where information about a visitor in the EEA, the United Kingdom or Switzerland is transferred to the United States, the transfer relies on the European Commission's standard contractual clauses or an equivalent safeguard. You can ask us for details of the safeguards that apply.

How long we keep it

We keep personal information for as long as the purpose it was collected for requires, and longer only where a law requires it or where you have consented.

In practice that means an enquiry and the correspondence around it are kept while the introduction is live and for a reasonable period afterwards, in case you come back to it; server logs are kept only as long as our hosting provider needs them for security and diagnostics, which is a matter of days.

When a retention period ends, we delete the information or anonymise it so it can no longer identify you. You can ask us to delete it sooner, as described below.

Your rights

You can ask us to:

  • give you a copy of the personal information we hold about you
  • correct anything that is wrong or incomplete
  • delete it
  • restrict how we use it, or object to our use of it where we rely on legitimate interest
  • send it to you, or to another provider, in a portable format
  • stop sending you marketing, at any time
  • withdraw a consent you have given, without affecting anything we did before you withdrew it

Write to hello@ashworthdrake.com and we will answer within one month. We may ask you to confirm who you are first. There is no charge.

Visitors in the European Union, the United Kingdom and Switzerland

Because we offer this service to people in Europe, the EU General Data Protection Regulation applies to our processing of your information, and the equivalent UK and Swiss laws apply to visitors there. This section supersedes anything elsewhere in this policy that conflicts with it.

The rights listed above are your rights under those laws. In addition, you have the right to complain to the data protection authority of the country you live or work in. We would rather you told us first, so we can put it right, but that route is always open to you.

Where we process your information for direct marketing, you can object at any time, free of charge and without giving a reason.

Children

This site is meant for adults buying property. We do not knowingly collect information from anyone under 18. If you believe a child has sent us personal information, contact us and we will delete it.

Changes to this policy

When this policy changes we publish the new version here and update the date at the top of the page. If a change matters to how we use information you have already given us, we will tell you directly, and where the law requires it we will ask for your consent again.
